Terms of service
Welcome to COLLEXSTAR. By accessing or using our website, store, or services (collectively, the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy, Refund Policy, Shipping Policy, and Legal Notice, which together govern your use of the Services. If you do not agree to these Terms and policies, please refrain from using the Services.
Nothing in these Terms of Service, or any of the policies referred to above, limits your rights under the Australian Consumer Law (ACL).
Who We Are
COLLEXSTAR is an authorised retailer and/or distributor of products supplied by third-party brands, which may include, but not limited to; Let’s Play Games, Wizards of the Coast, The Pokémon Company, Bandai, Topps, Ultra PRO, and other affiliated distributors. All trademarks, logos, and product names associated with these brands remain the exclusive property of their respective owners. COLLEXSTAR is not the manufacturer or rights-holder of these products and makes no claim of ownership over any third-party intellectual property.
Your Account
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use our Services. You are responsible for maintaining accurate account information and safeguarding your login credentials. Accounts must not be transferred or sold.
By using our Services, you represent and warrant that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian before using our Services, and they accept these Terms on your behalf.
Products
We make reasonable efforts to display products accurately; however, colours may vary depending on your screen. Product descriptions, pricing, and availability are subject to change without notice.
Some products sold through our store are manufactured and owned by third-party brands, including but not limited to; Let’s Play Games, Wizards of the Coast, The Pokémon Company, Bandai, Topps, and Ultra PRO. Due to distributor allocation policies, certain items may be limited.
COLLEXSTAR is an authorised reseller and/or distributor for certain products and brands only, where expressly stated. Other products are sourced through legitimate third-party supply channels and are sold in accordance with applicable laws and supplier agreements. Product availability, specifications, and packaging may also change at the manufacturer’s discretion.
Orders
Placing an order constitutes an offer to purchase and is not accepted until we confirm it and receive payment in full. We reserve the right to refuse, cancel, or limit any order at our discretion.
Pre-order items are not yet in stock. Any stated release or delivery date is an estimate and may change due to supplier, production, or shipping delays. We will notify you of any significant delays.
All purchases are subject to our Refund Policy.
Expressions of Interest (EOI)
Available to Australian customers only.
An EOI does not constitute a purchase or a contract. It is free to submit and places you in an allocation queue without charge.
Payment is only collected once your allocation is confirmed by us in writing via email. No contract exists until confirmation is issued and full payment is received.
Allocations are prioritised in the order EOIs are received. We reserve the right to decline or limit any EOI, as subject to availability or at our discretion.
You will have 48 hours from receiving the confirmation email to complete the payment. After this period, we are not obligated to re-offer the allocation or honour the price.
Final quantities are determined by our suppliers. If we are unable to fulfil a confirmed and paid EOI in whole or in part, we will notify you and refund the unfulfilled amount within 10 business days. All rights under the Australian Consumer Law (ACL) are reserved.
Pricing and Payment
All prices are in Australian dollars (AUD) and include GST where applicable. Shipping costs are additional unless otherwise stated. Prices are subject to change without notice; however, the price at the time of order will apply.
By placing an order, you authorise us to charge your selected payment method.
Campaign Pricing
Campaign pricing is valid only for EOIs submitted during the active campaign dates displayed on our website (in Australian Western Time). The campaign price is locked upon submission during the active campaign period, provided payment is completed within 48 hours of allocation confirmation. EOIs submitted outside the campaign period are not eligible for campaign pricing. Campaign pricing is final and non-negotiable; no price adjustments or refunds will be made if pricing changes after your allocation is confirmed and paid.
Campaign allocations are limited by supplier availability. If your EOI is submitted during the campaign but confirmation is issued after the campaign ends, the campaign price applies only if you complete payment within 48 hours. We reserve the right to modify, extend, or end campaign dates at any time. Nothing in these terms limits your rights under the Australian Consumer Law (ACL).
Cancellation and Strike Policy
Following payment, customers may request cancellation within 48 hours of payment.
After the 48-hour cancellation period has expired, any cancellation of a confirmed and paid Expression of Interest (EOI) order will result in a Strike being recorded against the customer's account.
COLLEXSTAR operates a two-strike policy for Expression of Interest (EOI) campaigns:
- First Strike: A warning will be issued and recorded against your account.
- Second Strike: Your account will become permanently ineligible to participate in future Expression of Interest (EOI) campaigns.
COLLEXSTAR reserves the right to determine whether a Strike should be applied based on the circumstances of each cancellation. This Strike Policy applies only to change-of-mind cancellations and does not affect your rights under the Australian Consumer Law.
Intellectual Property
All content available through our Services is owned by COLLEXSTAR or used under licence. Content may only be used for personal, non-commercial purposes.
Third-Party Tools
We may provide access to third-party tools or services. These are supplied “as is,” and we are not responsible for their performance or any issues arising from their use.
Privacy
Our handling of personal information is outlined in our Privacy Policy. Our Services are hosted by Shopify, which maintains its own privacy practices.
Errors
We reserve the right to correct any errors, inaccuracies, or omissions at any time, including cancelling orders where product information or pricing was incorrect.
Prohibited Use
You must not use our Services for any unlawful, harmful, or infringing activities.
Fraud, Chargebacks, and Verification
We reserve the right to verify orders, request additional information, and refuse or cancel any order we reasonably believe to be suspicious, fraudulent, or inconsistent with our policies. If a chargeback or payment dispute is initiated, we may suspend the associated order or account while the matter is investigated. We encourage customers to contact us first to resolve any issues before disputing a charge.
Communications
By using our Services, you consent to receive transactional and service-related communications from us by email or other electronic means. These may include order confirmations, shipping updates, account notices, and policy updates.
Marketing and promotional communications are sent separately and in accordance with our Privacy Policy and applicable Australian law. You may opt out of marketing emails at any time by using the unsubscribe link in any such communication. Opting out of marketing communications will not affect transactional or service-related messages.
Termination
We may suspend or terminate your access to the Services at any time without notice. Any obligations incurred prior to termination will remain in effect.
Account Deletion
You may request the deletion of your account at any time by contacting us at info@collexstar.com. We will process your request in accordance with our Privacy Policy and applicable law. Please note that certain information may be retained where required by law, for fraud prevention, or to fulfil any outstanding obligations.
Warranties
Our Services and products are provided on an “as is” basis to the extent permitted by law. Nothing in these Terms excludes or limits your rights under the ACL.
Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss. Your rights under the ACL are not affected.
Indemnity
You agree to indemnify and hold COLLEXSTAR harmless from any claims arising from your breach of these Terms or misuse of the Services.
Force Majeure
We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including carrier disruption, supplier shortages, labour disputes, natural disasters, government action, or other similar events.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Legal Notice, form the entire agreement between you and COLLEXSTAR regarding your use of the Services.
Governing Law
These Terms are governed by the laws of Western Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Western Australia.
Dispute Resolution
If a dispute arises in connection with these Terms or your use of our Services, both parties agree to first attempt to resolve the matter in good faith through direct communication. We encourage you to contact us at info@collexstar.com before escalating any matter.
If the dispute is not resolved within 30 days of written notice, either party may seek resolution through the courts of Western Australia in accordance with the Governing Law clause above.
Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief where necessary.
Changes
We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
